A. Introduction and Acceptance of Terms
Modern Art Etc., Inc. (“we”, “us”, “our” or the “Gallery”) is committed to protecting your privacy, in your use of our website located at www.modernartetc.com or any successor or replacement website (the “Site”), and in connection with any transactions you make with the Gallery and/or through the Site. This Statement sets forth our current privacy practices with regard to the information we collect from Site visitors and from those who transact business with us (collectively, “users”). When you access the Site or enter into any transaction with us, you acknowledge that you fully understand this Statement and agree to be bound by it, and you expressly consent to the information collection and use practices described in this Statement.
B. Information We Collect and How We Use It
We collect certain information from and about its users by, among other things, directly from our web server logs, from users, and by using cookies on the Site.
1. Web Server Logs
When you visit the Site, we may track the following information:
- Your Internet protocol address.
- Location from which you accessed the Site.
- The kind of browser or computer you use.
- Number of links you click within the Site.
- Date and time of your visit.
- Amount of time you spent on the Site
- Name of your Internet service provider.
- Web page from which you linked to the Site.
- Pages you viewed on the Site.
2. Use of Cookies and Web Beacons
We use Internet cookies to personalize or enhance your user experience. An Internet cookie is typically a small text file that is placed on your hard disk by a web server. A primary purpose of cookies is to provide a convenience feature to save you time. For example, if you personalize a web page, or navigate within a site, a cookie helps the site to recall your specific information on subsequent visits, which simplifies the process of delivering relevant content and eases site navigation by providing and saving your preferences and login information as well as providing personalized functionality. Your web browser gives you the ability to decline cookies; you can modify your browser settings to achieve this. However, if you do so, your experience on the Site may be less optimized, and you may not have access to some Site functionality.
In addition, we may use web beacons, small snippets of code that allow a website to transfer or collect information through a graphic image request, and that may assist the Site with regard to Site usage analytics, advertising auditing and reporting, and content and advertising personalization. Some of these web beacons may be placed by third-party service providers to help determine the effectiveness of advertising campaigns or e-mail communications. Web beacons may be used by these service providers to place a persistent cookie on your computer, which permits the service provider to recognize your computer each time you visit certain pages or e-mails and compile anonymous information in relation to those page views, which in turn enables us and our service providers to learn which advertisements and e-mails bring you to the Site and how you use the Site. We reserve the right to share such aggregate statistics and anonymized personal information with such advertisers and partner companies. In addition, this information is used as part of web analytics to optimize the Site for our users.
3. Personal Information from Users
Site users can establish an account to order and purchase Artwork (which is defined in the Terms and Conditions Agreement). In order to establish an account, you will be asked to input some personal information such as your name, address, email address, telephone number, account number and other necessary information. In the ordinary course your account username will be your email address, and you will create your own password. We do not have access to your password, which it is encrypted/hashed on the server. If you forget your password, you will be sent a link to reset the password. With respect to your financial information, ordinarily we do not receive or have access to any credit or debit card information, all of which is held by our secure payment processor, currently Authorize.net. However, in the event that we take credit or debit card information by telephone, we will immediately pass such information to our secure payment processor, and delete such information from our files. We will not retain any financial or credit card information that you provide to us. It is also possible that you will be asked to provide necessary personal information if we are asked to assist you in connection with a particular purchase or transaction. For example, such data may be warranted in order to provide online technical support and troubleshooting.
We will not disclose personally identifiable information we collect from you to third parties without your permission except to the extent necessary including:
- To fulfill your transactions and orders/purchases of Artwork.
- To prevent crimes or misconduct or cooperate with law enforcement as the Gallery deems appropriate in its sole discretion.
- To respond to legal process, court or administrative orders or comply with law.
- In connection with a merger, acquisition, sale or liquidation of the Gallery or assets thereof.
C. Children
The Site is not directed at children under 13 years of age, and children under 13 years of we urge all children under 13 years of age not to use the Site or submit any personally identifiable information about themselves.
D. Modifications to This Statement
We may update this Statement from time to time. When we modify this Statement, we will update the Effective Date at the top of this page. We encourage you to review this Statement when you visit the Site from time to time so that you are updated on the treatment and protection of your personal information. Your continued use of the Site and your ordering/purchasing Artwork constitutes your agreement to this Statement as modified from time to time.
